Immoplanit provides this privacy policy to inform you of our policies and procedures regarding the collection, use and disclosure of personal information we receive from users of www.immoplanit.be (this "Site") and the tablet application(s) (this "App"). This Privacy Policy applies to information you provide to us through this Site and this App. Our Privacy Policy may be updated from time to time, and we will notify you of any material changes by posting the new Privacy Policy on the Site at https://www.immoplanit/privacy-policy.

A. Information Collection

While using this Site and/or App, you may provide us with personally identifiable information. This refers to information about you that may be used to contact or identify you, and information about your use of and activities on our Site and our App that may be associated with you ("Personal Information"). Personal Information we collect may include, but is not limited to, logo, your name, phone number, credit card or other billing information, email address and home and business mailing address. Personal Information may also include information you provide to us regarding your preferences and interests that you express while using our Site and App.

When you visit the Site or use the App, our servers automatically record information that your browser or App sends when you visit a website or use the App. This information may include, but is not limited to, your computer's Internet Protocol address, browser type, the web page you visited before coming to our Site and information you search for on our Site. Like many websites, we may also use "cookies" to collect information. A cookie is a small data file that we transfer to your computer's hard drive to keep track of data. We may use "persistent cookies" to store your registration ID and login password for future logins to the Site; and we use "session ID cookies" to enable certain features of the Site, to better understand how you interact with the Site and to monitor overall usage and routing of web traffic on the Site. Personal Information is or may be used for the following purposes: (i) to provide and improve our Site, services, features and content, (ii) to administer your use of our Site, (iii) to enable you to enjoy and easily navigate the Site,(iv) to better understand your needs and interests, (v) to respond to requests you may make, (vi) to personalise your experience, (vii) to provide or offer software updates and product announcements, and (viii) to provide you with further information and offers from us or third parties that we think may be useful or interesting to you, including newsletters, marketing or promotional materials and other information about services and products offered by us or third parties. If at any time you decide that you no longer wish to receive such messages, please follow the "unsubscribe" instructions in the messages sent to you, or update your "account settings" information. We use information we obtain through technical means (such as automatic registration by our servers or through the use of cookies) for the above purposes and to monitor and analyse the use of the Site, App and our services, for the technical administration of the Site and App, to enhance the functionality and usability of our Site and App, to better tailor it to your needs, to generate and derive useful data and information regarding the interests, characteristics and usage behaviour of our users, and to verify that visitors to the Site and App meet the criteria necessary to process their requests.

Immoplanit does not share, sell, rent or trade personally identifiable information with third parties for their promotional purposes. Immoplanit may share collected information with other companies working on Immoplanit's behalf.

IMMO PLANIT CV (hereinafter "Controller", "we", "us", "IMMOplanit") respects your privacy and strives to treat your personal data with due care and confidentiality at all times. We hereby undertake to comply at all times with the General Data Protection Regulation ("AVG" or "GDPR") and other applicable regulations.

For the processing activities further described in the privacy statement, we act as "processing controller". This means that we determine for what purposes (why) and by what means (how) your personal data are processed.

What does 'process personal data' mean?

WHAT WILL PERSONAL DATA BE USED FOR?

 Processing grounds

We may process your personal data for the following purposes: 

Necessary for the formation and/or performance of an agreement

Pre-contractual phase:

  • Contacting the potential contracting party, responding to correspondence, negotiating;
  • Providing and/or requesting information in the context of concluding a contract;
  • Drafting agreements (both agreements with customers, suppliers, and prospective employees);

Contractual phase:

  • Customer management

Legal obligation

Compliance with legally prescribed retention periods of invoices and other accounting and tax documents.

Improving the quality of the service and evaluating and maintaining data and statistics related to the activities of the Controller, in the broad sense.

Permission

For retention for a period not exceeding two years of personal data of candidate employees with an interesting profile, in a recruitment reserve.

Sending electronic newsletters if you have subscribed to them via our website.

The use of analytical cookies on our websites to understand how you use our website, with a view to detecting navigation problems, among other things, and making the website more user-friendly and attractive.

With whom do we share your personal data?

Your data will always be kept confidential, not traded, sold, rented or passed on to third parties outside the contractual relationship or a specific assignment.

Where necessary, we use external service providers, so-called "processors", to support our operational purposes such as the management of our IT systems. These external service providers may carry out certain processing of personal data on our behalf. We will only share your data with these external service providers to the extent necessary for the processing purpose. The personal data may not be used by them for other purposes. Moreover, these service providers are contractually bound to ensure the confidentiality of your data by means of a so-called "processor agreement" concluded with these parties.  

In rare cases, the Controller may have to disclose your personal data pursuant to a court order or to comply with other mandatory laws or regulations. The Controller will make reasonable efforts to inform you in advance in this regard, unless subject to legal restrictions.

Specifically, where relevant in your situation, we share your personal data with the following third parties for the following purposes, with these third parties acting as processors on our behalf in certain cases:

  • Transport or postal companies 
  • Payment service providers
  • IT partners
  • Providers of (cloud) software
  • Other suppliers or subcontractors
  • Government agencies, courts and certain liberal professions such as accountants and lawyers

As far as possible, your personal data will be kept within the European Economic Area. However, some of your personal data may be processed outside the EEA. This will only be done to countries that the European Commission has confirmed ensure an adequate level of protection of your personal data, or where other measures have been taken to ensure the lawful processing of your personal data in these third countries.

How long do we keep your data?

Personal data will only be processed by the Controller for a period necessary in function of the purposes of the processing. Thereafter, your personal data will be deleted or anonymised.

For example:

  • With regard to our customers, this concerns the performance of the agreement you have entered into with us. With regard to our suppliers, this concerns managing the cooperation.
  • If certain personal data appears in our records, we are obliged to keep it for seven years.
  • If you apply for a job with us, we will delete your personal data (CV, cover letter, correspondence) within a reasonable time after the end of the application process, if it did not lead to a cooperation. With your consent, we will keep this personal data for up to a maximum of two years.

SAFETY MEASURES

We provide appropriate technical and organisational security measures to avoid, within the scope of our activities, the destruction, loss, falsification, alteration, unauthorised access or inadvertent disclosure to third parties of personal data collected as well as any other unauthorised processing of this data.

Under no circumstances can we be held liable for any direct or indirect damage resulting from an erroneous or unlawful use by a third party of your personal data.

Rights of data subjects

Right of inspection and copy

You have the right to access and obtain a copy of your personal data. This right also includes the possibility of requesting further information on the processing of your personal data, including on the categories of personal data processed about you and for what purposes.

Right of adaptation or rectification

You have the right to have your personal data amended if you believe we have incorrect personal data.

Right to exchange data (right to oblivion)

You have the right to request that we delete your data without unreasonable delay. However, we will not always be able to comply with such a request, including when we still need the data in function of an ongoing contract, or when keeping certain of your data for a specific period of time is required by law.

Right to restriction of processing

You have the right to restrict the processing of your data. In this way, the processing is temporarily stopped until, for example, there is certainty about its accuracy.

Right to withdraw your consent

Where processing is based on your consent, you have the right to withdraw this consent at any time by contacting us.

Right of objection

You have the right to object to the processing of your data based on our legitimate interests. This should be based on reasons specific to your situation. In this case, we should stop processing unless we provide compelling legitimate grounds to continue processing.

However, you can always object to the use of your data for direct marketing purposes, after which we are obliged to stop processing for these purposes. 

Right of transferability

You have the right to obtain in electronic form your personal data that you yourself have provided to us with your consent or for the performance of a contract. That way, they can be easily transferred to another organisation. You also have the right to request us to transfer your data directly to another organisation, if this is technically possible.

Right to complain to your supervisory authority

Should you believe that we are processing your data in an incorrect manner, you always have the right to lodge a complaint with your data protection supervisory authority. You can do so with the supervisory authority of the EEA member state where you normally reside, have your place of work or where the alleged breach has occurred. As we conduct our business from Belgium and have no branches in other EU Member States, please refer below to the contact details of the Belgian Data Protection Authority.

For further information and contact details of the supervisory authority of each EEA member state, please refer to this website page of the European Data Protection Board with all relevant contact details. In addition, you can also always turn to the competent civil court to file a claim for compensation.

AMENDMENTS

The Controller reserves the right to change this privacy notice at any time by notifying users on this page. We encourage you to check this page often for any changes. The date of the last modification is indicated at the top of the page. 

If a data subject objects to any change in the policy, the user should not continue to use this website and/or stop cooperating with us. He may request the Controller to delete the personal data. Unless otherwise indicated, the privacy policy valid at that time will apply to all personal data stored by the Controller about data subjects.

C. Sharing and disclosure of information

Immoplanit Users

We will display your Personal Information on your account page and elsewhere on the Site and App according to the preferences you have set in your account.

Service Providers, Business Partners and Others

We may employ third-party companies and individuals to facilitate our service, to perform the service on our behalf, to perform Site-related services (including but not limited to data storage, maintenance services, database management, web analytics, payment processing and improvement of Site features) or to help us analyse how our Site and service are used. These third parties will only have access to your Personal Information and your Site descriptions to perform these tasks on our behalf.

Compliance with laws and law enforcement requests; Protection of IMMOplanit's rights

We may disclose to parties outside Immoplanit files stored in your Immoplanit and information about you that we collect when we believe in good faith that disclosure is reasonably necessary to (a) comply with a law, regulation or mandatory legal request; (b) protect the safety of any person from death or serious bodily injury; (c) prevent fraud or abuse of Immoplanit or its users; or (d) protect Immoplanit's proprietary rights. If we provide your Immoplanit files to a law enforcement agency as set out above, we will remove Immoplanit's encryption from the files before providing them to the law enforcement agency. However, Immoplanit will not be able to decrypt files that you encrypted before storing them on Immoplanit.

Business transfers

Immoplanit may sell, transfer or otherwise share some or all of its assets, including your Personal Information, in connection with a merger, acquisition, reorganisation or sale of assets or in the event of bankruptcy.

D. Customer details

Customers of Immoplanit may electronically submit data or information to the Company's services ("Customer Data"). Immoplanit will not view, share, distribute or reference such Customer Data. Immoplanit may only access Customer Data for the purposes of providing the Services, preventing or remedying service or technical problems, at the request of a Customer in connection with customer support matters, or as may be required by law.

  • Change or delete your data => You can check, update, correct or delete the Personal Information you have provided in your registration or account profile by changing your "account settings".
  • Security => Immoplanit is committed to the security of your information. We take reasonable measures to protect your information from unauthorised access.
  • Our policy towards children => This Site is not directed at children under 18 years of age. We do not knowingly collect personally identifiable information from children under the age of 13. If a parent or guardian learns that their child has provided us with personal information without their consent, they should contact us at info@immoplanit.be . If we learn that a child under the age of 13 has provided us with Personal Information, we will delete such information from our files.
